These Terms of Service ("Terms") govern your access to and use of the website operated by Pressed Moments, and the purchase of any products sold through it (the "Site"). By using the Site or placing an order, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to utilize this Site or place a custom order.

3. Custom & Personalized Products

The core of our service involves manufacturing made-to-order items using photos and personalization text supplied directly by you via our designated uploaded tools (including the NINEMAGS application). Because each item is produced individually based on user-generated content:

• Minor variations in print color, alignment, cropping, sheen, or overall finish are inherent to custom sublimation and printing processes. These minor industrial variations do not constitute a manufacturing defect.
• Once an order enters our production and printing phase, it cannot be modified, updated, or canceled.
• All sales of personalized items are final, subject strictly to the remake and damage-resolution terms set out in our Refund Policy.

4. User-Submitted Content — Your Photos & Intellectual Property

When you upload photos, designs, logos, or submit personalization text (collectively "User Content") to the Site, you represent and warrant that:

• You own or have obtained all necessary licenses, rights, consents, and permissions to authorize us to use the User Content for the purpose of processing, printing, and manufacturing your order.
• The User Content does not infringe any copyright, trademark, right of publicity, right of privacy, corporate logo rights, or any other proprietary right of any third party (including, without limitation, characters, designs, or imagery owned by entertainment, media, or sports organizations).
• The User Content is not obscene, defamatory, hateful, harassing, or otherwise unlawful.

We reserve the absolute right, but have no legal obligation, to refuse to process or manufacture any order whose User Content we reasonably believe violates these Terms, infringes third-party rights, or violates applicable local, state, or federal law.

5. Indemnification

You agree to defend, indemnify, and hold harmless Pressed Moments and its owners, employees, contractors, third-party manufacturing partners, and agents from and against any and all claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) any claim of copyright, trademark, right of publicity, right of privacy, or other intellectual-property infringement based on the images or text you uploaded; (c) your violation of these Terms; or (d) your violation of any law or right of a third party.

6. Orders, Pricing & Acceptance

Your submitted order constitutes an offer to buy. We reserve the right to accept, decline, or limit any order at our sole discretion, including after an order has been submitted, in cases of pricing errors, suspected fraud, clear technical glitches, or photo upload validation failures. A binding contract is formed only when we dispatch the official order-confirmation email.

All prices are shown and processed strictly in USD. Applicable sales tax (including Ohio state sales tax where mandatory) is calculated and fully disclosed to you before final payment is captured.

7. Shipping & Delivery

All fulfillment and delivery logistics are strictly subject to our Shipping Policy. Estimated transit timeframes are provided directly by our carriers (such as USPS) and are estimates only. We are not liable for transit delays once a package has been handed over to the carrier, particularly given the made-to-order production window required prior to dispatch.

8. Intellectual Property — Site Assets

All content displayed on the Site (excluding your personal User Content) — including but not limited to logos, custom graphics, product imagery, website copy, layout designs, and software widgets — is owned by or licensed directly to Pressed Moments and is protected by U.S. and international copyright, trademark, and intellectual-property laws. You may not reproduce, modify, scrape, distribute, or publicly display any such assets without our prior written permission.

9. Relationship with Shopify

Our store is hosted on the e-commerce platform operated by Shopify Inc. Shopify provides the online infrastructure that allows us to securely display products and process payments. Your interaction with the Site is subject to Shopify’s underlying system terms; however, nothing in these Terms transfers operational responsibility for custom manufacturing, file rendering, or shipping liabilities from Pressed Moments to Shopify Inc.

10. Governing Law & Dispute Resolution

These Terms, your access to the Site, and any transactions completed through it shall be governed by and construed in accordance with the laws of the United States and the State of Ohio, without regard to conflict-of-law principles. Any legal action, dispute, or proceeding arising under these Terms shall be resolved exclusively in the state or federal courts located in the State of Ohio, and you hereby consent to the personal jurisdiction of such courts.

11. Prohibited Site Uses

You agree not to use the Site or its infrastructure to: (a) violate any international, federal, or state law; (b) infringe upon the intellectual property of Pressed Moments or others; (c) upload malware, viruses, or destructive code; (d) scrape or track personal data of other users; or (e) submit fraudulent transactions or false image assets.
